You will want to petition the court for instruction and show the efforts taken to locate the person named in the will, such as personal investigator. If there is a petition to pronounce the missing person deceased, there is another procedure. The court may order the share for the person to be deposited in the State's unclaimed property division or to that person's heirs. If the person is deceased, there is a different result, but the court may need evidence of that. Please contact me if you would like to discuss the situation in more detail. 888-988-5297 (LAWS)
