Legal Question in Wills and Trusts in Michigan

My husbands. Illogical father has just passed away. He was not married and my husband was his only child. What rights does my husband have and is there anything that he should be aware of so that his family doesn't try to take advantage of him during this time?

Assuming he was not adopted by someone else, he is the sole heir of the estate, unless there is a will which says otherwise. He should take prompt action to open a probate estate assuming there are probate assets. If your husband is the sole heir, he should secure the assets and begin the probate process. I would like to assist him with this project. Most estates that I am involved with are completed in 6 months. There will be a minimum of 4 months for creditors of the deceased to make claims. However, the assets, such as a house, may be sold during that time. Having a lawyer assiting will allow your husband to avoid any family issues by stating "Let me check with the attorney first."
