Legal Question in Wills and Trusts in Michigan
Regarding inheritance tax in Pa. My father pased away in Dec. My mother is still alive and has been living in Mi with children due to her alzheimer's for the past 3 years. He had a trust set up. As his estate was under the 5 million exemption I believe everything will go into the "family/bypass trust and not the pour over trust. I have a few questions as I never get clear answer from our attorney. Will everything be taxed at the time of his death. Will it be taxed at the 41/2 % as it will really go to his 2 children at the time of my mothers death. Second question. We are trying to make my mother a Mi resident as she has lived here for 3 years and there is no inheritance tax in Mi.
She will continue to own the house in Pa. When she dies how is the house taxed, or isn't it. I guess it is like owning vacation property If they are claiming a homestead exemption should we change it to help support her Mi residency.
