Legal Question in Wills and Trusts in Michigan

Intestate Estate

My Mother passed away and did not leave a will. However she did owe an attorney some money. I received in the mail a notice for a Petition for probate and appointment of personal representative (INTESTATE ESTATE) from this attorney. We did not open an estate for her because the only thing she owned was her house and the property it is on.

How can we protect her property and is this legal for an attorney to do?

It sounds like the house and property are probate assets and yes, the attorney can take the action he/she has taken. Just like you, attorneys are entitled to be paid for the work they do. When we go to work (referring to everyone), we have the expectation that we will be paid and that we can pay our bills, support our families, etc. from the money we receive from working. Otherwise, we could stay home and watch television.
