Legal Question in Wills and Trusts in Michigan

locating wills

I would like to know how long an original will is kept on file and available after it has been changed. And how one would go about gettting a copy. Thank you in advance,--name removed--

Re: locating wills

Each county has its own filing methods and time limits. I recommend that you contact the county in which you believe the will to be on file with, and request a copy. The will may not be on file anywhere unless the case went through probate. If it isn't, you may want to try the attorney who prepared the will, or the executor of the will. The executor is required to notify all parties listed in the will upon the subject's death. A will does not have to be filed with a court to be valid. The only requirements of a valid will is the signature of the person whom the will is for, and the signature of two witnesses. If it is on file with the Court, the executor, or the attorney who prepared it, you can request a copy with a simple letter to the person, or agency in possession of the will.

Good luck. I hope this helps.
