Legal Question in Wills and Trusts in Michigan

Michigan Will

Scenario:

Man has 6 kids from previous marriage and woman has 2 from previous marriage. No kids together. They were married 24 years. Husband died. If there was not a will does wife get entire estate. What if his kids say there was a will and and they had a copy of it and wife did not know this till now. If the will actually did exist and was legal would the wife still get everything?

Re: Michigan Will

The intestate statutes, dying without a will, has a provision for distribution to a wife. The wife would not be entitled to the entirety in this scenario.

Regarding the will, if the will is proven to be his, it will not matter that his wife was unaware of it.

I must recommend in this scenario that the wife get a copy of the will and have it reviewed by a qualified estate planning attorney. We would be happy to assist her. Please feel free to contact us directly. Good Luck.
