Legal Question in Wills and Trusts in Michigan
Mother's Death
I think the house will go to my Step-Dad. I am an only child. I have to be careful because I want to be able to come to my Mom's house. So many of my things and her things are here. I live in CA and come back and forth to MI. I think my Step-Dad will be going to probate. I am not sure all that is involved. I think it might be about my Mom's bank account. She wanted to put me on it at Christmas, and I just told her to do it whenever on her own. My Step-Dad wants the pin code to her bank card. I don't want to give it to him. A lot of the money I think that is in there was left to my Mom from my Aunt Nana and Uncle Bob. How do I find out if my Step-Dad has gone to court? Does someone contact me? Can I only check by hiring a Lawyer? If my Mom left a will it is very possible my Step-Dad will never tell me. I don't know that if my Mom did it she had a Lawyer file it. What do I do? Thank you.

You can check in the probate court in the county in which your mom resided. You can, in theory, do everything yourself. But, in practice, you don't know how. If you do not protect your rights no one else will.

Make sure your step-dad knows how to contact you. Do as Mr. Roth suggested and check the court records. If probate is open file a request for special notice. Do you have you mother's bank records? If you have access, gather as many financial documets as possible. Consult with a MI attorney ASAP.
