Legal Question in Wills and Trusts in Michigan

My mother's only "estate" is $300.00 in a savings and checking account from one bank. I am the only heir. Bank will not release the money without probate. How can I get around this? The cost of probate is more than the estate.

If your mother died in Michigan, you should go to the court house in the county where your she died and obtain a form called, "Sworn Closing Statement, Summary Proceeding, Small Estate". The cost to file the form and obtain an Order that should satisfy the bank is $25.00. This should be all you need.
