Legal Question in Wills and Trusts in Michigan
Non Marital Survival Assets-Probate court
I have been living with my boyfriend since 1997, I recently moved into my own apartment. The mortgage is in his name, I would like to know should I have been compensated for living there all that time due to the fact that I was forced to leave, because of irreconcilable differences.
Also, because I was contributing to the household, shouldn't he have been forced to obtain an eviction notice to force me to leave since I had been contributing to the household?
We also have a two year old son together.
Also, we have since then made up and we are egotiating our return. I would like to know, because we are not married and the I am not on the deed, if something should happen to him and he dies. Can his daughter from a previous relationship who is now 18 come and force me to leave?
Also, if we for some odd reason get married and my name is still not on the deed would I get the house or would his descendants automatically get the house? Do they have a right to force me out since my name is on the deed and this would be considered non-marital property, because he had the house before we got married.

Let me give you some advice. You probably won't listen to me but I'm going to tell you anyway. First, don't move in with your boyfriend until your name is on the deed. Second, get an order requiring him to pay child support. When the support is not paid, you will then be able to get the support paid by selling his property, such as the house. By not being married, you have no rights if he dies, etc. Start sticking up for yourself and your child. Your child will grow up and wind up with no protection.
