Legal Question in Wills and Trusts in Michigan

Parent died in 1999 - Statute of limitation?

I live in FL. Parent lived and died in Lansing, MI. Trustee is sibling who lives in Upper Peninsula in MI. Parent died in 1999 and Trustee still owes me account outstanding which refuses to give me. I need to sue her. Is there a statute of limitations on getting this money from her? Do I need to hire attorney from Lansing, MI? I have all pertinent account info and trust papers. Account is now valued at about $21,000. I want my money.

The proceeding would generally be in the county where the trustee lives, not the county where your dad died. A possible exception would be if there is already a probate proceeding going in Lansing.

The trustee should have kept you informed. Again, generally, since trusts are not supervised by the court, you are most likely within any statute of limitations.

My firm can handle matters in Lansing, or even the Upper Peninsula (we have a family cottage in McMillan, and I am at my northern 'office' a lot). Having said that, given the modest amount involved, any litigation can be expensive. I would suggest retaining an attorney to write a demand letter, and see what happens.

Best Regards,

Pat Prince

Hello, I have received a copy of your e-mail regarding your parents' estates. You need to act promptly so that the Court does not approve any distribution that would be unfair. Under Michigan law it is not always necessary to even have a Court hearing on many matters. Please contact me or my associate, Karen Crusse, to discuss the details of this case and your options.
