Legal Question in Wills and Trusts in Michigan

Who Pays Deceased Bills?

My mother died leaving no estate. Her home was in a quit claim deed with life lease with her granddaughter. She had no money in accounts or any personal possessions so who pays for her left over medical & credit card bills? Do we have to go through probate? She had no surviving spouse.

Re: Who Pays Deceased Bills?

Generally, if no estate was left and no one co-signed on or otherwise guaranteed the debts, then there is nothing for the creditors to go after. Just tell them that she died leaving no assets. Likewise, if there are no assets, there is no reason to open a probate estate. I assume that your description of the quit claim deed means that it was deeded to the granddaughter and a life estate was retained by your mother. If that is the case, then the real property passes outside of probate.
