Power Of Attorney

Who would hold the power of attorney on a single, divorced woman with two children (both over 18 and one in jail) if the woman was to become ill without assigning anyone??

POAs by definition are designated or "assigned" by the person giving the POA. Otherwise should you become incapacitated a suitable Guardian Conservator or Advocate would be appoitned by the Court which migh appoint a family member or third party (corporation) to act in your stead. Best to designate a close friend if you dont trust your children to do it.

An interested party would have to petition the court for a guardianship/conservatorship.
