Legal Question in Wills and Trusts in Michigan
powere of attorney
My brother is power of attorney for my mother. She is alive and well but has some memory impairment secondary to a brain tumor. How can I become power of attorney? My brother has stole many times from her and my father (who is deceased) and I can only imagine what he would do when he has full authority of the estate. I am sole caregiver to my mom and I would like to know if I can assist her in changing the will. Thank you very much.

You should petition the court to have you appointed guardian and conservator of your mother. Your brother may contest it and the judge would decide who would be the guardian and conservator. It would probably be a good idea to utilize the services of a good probate lawyer. I do probate in Wayne, Oakland, Macomb and Washtenaw counties. Bill Stern 248-353-9400
