Legal Question in Wills and Trusts in Michigan

Probate

Is there ever an exception to the probate law in michigan. My mother died, being married for 3 years, no will (husband destroyed it) he is getting everything and there are 5 grown children. All of my grandmother's heritage items are still in the house. All monies inherited from grandmother is gone. Help.

Re: Probate

It appears that an attorney may be able to assist you. First, you would want to prove that the will was destroyed if you have proof. Second, it appears that if the husband is receiving all of the items it MAY be in violation of the rules in place for when someone dies without a will, intestate. Depending on the size of your mother's estate the husband MAY not be entitled to all of the property and finances.
