Repayment to Medicaid from estate settlement
Can Medicaid claim money from the estate of a decedant after a settlement award from a wrongful death suit? The decedant died in the hospital after being shot by police. Can they claim only a percentage, if any?

This is in response to your email of June 28, 2001, which this office received on July 2, 2001.
In some circumstances Medicaid may be able to recover money from the estate. However, if they can recover money from the estate they do not receive a percentage, but the amount of money they paid.
