Legal Question in Wills and Trusts in Michigan

successor trustee #2

Called attorney on 'declination to act as successor trustee' form & asked to see copy of mom's will and trust. He said trust contains such an obvious error (listing me as S.T. instead of dad) that he doesn't need my signature to get it changed. I said I'd like to see documents before signing my rights away. He said I have no rights to trust, they don't have to show me documents, and he will get it changed another way. Told me to rip up form. Should I still seek legal advice? How can I tell if I have rights or not?

Unless you want to get taken advantage of by an attorney who is clearly playing below the belt, I would advise getting representation ASAP! visit www.kliszlaw.com to discuss. Tim Klisz

You should file a petition in the probate court asking for the court's guidance on the issue. Please visit my website at www.lawrefs.com and search under estates/probates for information on trusts, your rights, and a petition. If you would like me to assist you, please feel free to let me know.
