Legal Question in Wills and Trusts in Michigan

suicide

my brother committed suicide. Are his grown children allowed to get his life insurance policy? He has always had a mental illness. bipolar/severe depression, aniety. He's been to the hosp. several times, and to a psycritrist and has been on tons of different meds to help stablize him to no avail. I miss him dearly but I am more concerned about is children who are in financial difficulties. He had a 100,000. life insurance policy thru the Michigan Dept of Correction when he was granted in 2000 disabled. He was still getting all his pension, etc. Please help! The policy says no benefits if he committed suicide. Is there anyway to fight this? Please please help.

Re: suicide

It makes sense to check the death certificate and the insurance policy very carefully. Does the death certificate indicate that the cause of death was suicide? If the death was not officially ruled a suicide, there may be some other explanation for his death that would allow you to make the claim in good faith. Furthermore, it may be that his death did not meet the definition of suicide under the terms of the insurance policy.
