Legal Question in Wills and Trusts in Michigan
A Tangled Mess?
My mother died 11 years ago, without a will. Her name was on the house w/ my dad. My Dad remarried, sold the house, and put all of that money into his new wife's home. Could he have done this w/o a will from my mother? My father has now died, w/ no will, but there were a lot of assets in his name only, i.e, cars. We don't know if his name was added to the new wife's home or not, but there were a lot of possessions from before the marriage that are at the new wife's home that I and my sister would like to have. Also, we don't know if there was life insurance, or if we're entitled to part of our dad's pension. The step mom is saying that the pension stopped the day he died, but it's a Teamster's pension, and should not have, the same goes w/ my dad's retirement social security. Do my sister and I have the right to be able to request/demand access to our father's possessions to see what, if any, is left over from the house he owned with our mother? Also, how do we go about finding out if there was any life insurance policies?

Re: A Tangled Mess?
If your father died without a will, you and your sister are entitled to his one half of the community property. You'll need to hire a lawyer that deals with probate litigation that practices in the county where your father lived.
