Legal Question in Wills and Trusts in Michigan

Is there a time limit for probate

My aunt died 3 years ago. She had no children etc. My 2 brothers sister and I are her heirs. My sister has intention of keeping her property etc. She has been paying the property taxes. This property is not worth much, but there are alot of antiques etc. Is there a time frame when it will automatically become my sisters property?

Re: Is there a time limit for probate

Unless your aunt had signed a deed making your sister the joint owner of her property, the property has to go through probate, and will be distributed to her heirs equally, assuming she did not have a will, making a different distributin. It cannot become your sister's (or any other heir's) property 'automatically', no matter how long you wait.

Do a title search to see how the property is titled. If it is in your aunt's name alone, contact a lawyer to open an estate. If it was jointly owned, there could be an argument that the antiques were also jointly owned.

Our office is experienced in probate matters, so if you decide to retain a lawyer, feel free to call.
