Legal Question in Wills and Trusts in Michigan
Hello, I am trustee of my sisters trust account. I no longer want to be, my brother is next in line to take it over. I have tried to contact him my mail and he won't step up to the plate. My other brother is my sisters guardian and wants a joint account and said he was going to petiton the court for a joint account with my brother who is next in line. I have not heard anything from them after several letters. Can I assume they want no part of it or have someone else appointed by the court. Is there something I can do?

You cant force someone to take a fiduciary job unless they agree. I would suggest you hire a competent probate attorney to take over the Trusteeship if no relatives want the job. You may petition the court to relieve yourself of the duties and the court will appoint someone else. At that point your relatives will have to step up to accept the duties through a formal order of the court or the court will appoint an independant company or attorney who handles this type of matter.
