Unregisterd quitclaim deed
We have a copy of a quitclaim deed that went unregisterd since the 70's. The orginal property owner (signer of deed) is now desesed. The attorny that handled this deed is no longer in practice. The original deed is lost. There for we can not register it. We have plans to sell the property. How do we fix this situation?

An attorney will more easily handle this matter than you, however, if you desire to move forward without representation, I suggest that you contact the personal representative of the original property owner's estate. Look to the county in which the original property owner resided / died and contact their probate court to find out the name and phone number of the personal representative. I would expect that he would need to open back up the estate if it is not closed to regain his authority as personal representative so that he can execute another deed. You may have some issues with convincing him to undertake this burden and in that regard, an attorney will be of assistance.
