Legal Question in Wills and Trusts in Michigan

verbal wills

before my aunt passed away she

stated in front of her attorney and

her sister (the trustee) that i was the

beneficiary of her life insurance

policy. When i called the company

they said that it had changed when

she retired 5 years ago but she made

that statement last month. is there

anything i can legally do?

Re: verbal wills

It depends on whether your aunt's comments were actually expressing her wishes that you receive the benefits, or whether she was simply stating that she thought you were the beneficiary. And of course, the eyewitness would have to testify as to what he thought it mean too.

You can try to work this out with the family and see if they will agree to give you the life insurance proceeds. If not, you can dispute the disposition of her estate, etc., by retaining a lawyer to represent you. You need a lawyer in the state where your aunt passed away, as they would have jurisdiction over her estate.

Thanks.
