Legal Question in Wills and Trusts in Michigan

Will & Probate

Children's father died, in the state of Mich, leaving NO will but had a present wife. What is the State of Michigan's Law concerning this, as far as the children are concerned, about father's wealth, if any?

Re: Will & Probate

The estate will be probated according to Michigan's laws on intestate succession. The surviving spouse will get 1/2 of the intestate estate. The rest will go to the children. An estate will need to be opened and a personal representative appointed.
