Is the mutual will and the living will use the same or do you have to use them different or can i get them in the same package? Do the wills have to file with a lawyer?

A mutual will is generally where two people (usually husband and wife) each write a will giving most of the items to each other when one passes away.

A "living will" is a general document that is designed to provide directions for your care for medical reasons if you are not able to make those decisions.

A good attorney will be able to draft both documents for you. However, wills do not need to be filed with an attorney for any reason unless you wish that attorney to assist your estate at the time you pass away. Then the attorney would only need a copy after you pass away.
