Legal Question in Workers Comp in Michigan
comp doctor
I was attacked by a patient at work. I went to ER and to the comp doctor the next day. Comp doctor put me on work restrictions of avoid physical confrontations with patients. I called work they stated we cannot accomadate that restriction so youll be off work till the restriction is over. I would also recieve full benefits while off due to tjis assault. approximatley 10 minutes after my appointment the doctors office called and said your work cannot accomadate those restrictions so the doctor changed his mind and dropped your restrictions. My back was (is) very sore and vulnerable to futher injury. Patient assault is very common in my job. Should my work and comp doctor be talking back and forth? Is it legal?

Re: comp doctor
I would bet that you signed a release allowing the doctor to communicate with the employer. As far as workers comp, if you cannot work, no matter what the doctor says, you should get comp. You can file a petition, preferrably with a workers comp lawyer like myself. Unfortunately, the case takes some time to wind through the system. In the meantime, you have to live and pay bills. There is no easy answer to this situation. William S. Stern
