Legal Question in Workers Comp in Michigan

denied treatment for injury

On 6/7/2006 while performing my job at Tower Auto., an circuit board failed, which controled the light screen, allowing the air clamps to clamp my right hand to the fixture I was about to load...In an effort to free myself before machine cycled and pulled me inside it, I pulled and fought, twisted and turned to get lose...I have a class 2 ac joint shoulder seperation, still to this day and have been denied time off for x-rays, hospital, doctor visits and such..They make me use my vacation time, and even then only as they okay, for such occurances, even though the accident occurred at work...This machine was written up twice before accident and once after accident for non-repaired maintenance problems, which caused this condition to occur.. Should I seek attorney help in a suit against such practices, and aren't they liable for injuries which occur on the job? I have witnesses which seen the machine misperforming after the accident, as it still hadn't been fixed days later..I even had a report of accident filled out the day of injury, but they refused to send me to the hospital...just said ahh you'll be okay..I currently must wear a figure 8 brace constantly. It sounds like you need to file a union grievance. There is no case against the employer as workers comp is your only remedy and you need to be off for 7 consecutive days to get actual comp. You cannot sue your employer for negligence as the law prevents such suits unless the employer intentionally injures you. Sorry I don't have better news. William S. Stern
