Legal Question in Workers Comp in Michigan
Hit on head with 450 pound bundle of cardboard
at work when a 450 pound bundle of cardboard fell on me and forced me to the cement. We believe the equipment being used to move the cardboard was not equiped to do the job. several people had stated as such before my injury.nothing was done about the problem and i was injured while my coworker was trying to load the cardboard.I ended up with a L4 burst fracture and have been in severe pain for the past 3 years.I have been treated by doctors with no treatment other than physical therapy and pain medication. The doctors say that i am fine and need no further treatment and can go back to work. That is a joke because I was unable to work and had to retire early. I have since been to an orthopedic surgeon and he thinks I need spinal fusion and does'nt think the L4 fracture has even healed. What do I do now? I don`t think I was treated properly by the company doctors and the workmans compensation doctors.

Re: Hit on head with 450 pound bundle of cardboard
You raise lots of issues. First, even if your employer was totally negligent, you cannot sue for anything but workers' compensation. This has been the law for going on 100 years. Second, if you took a regular retirement, then for every dollar you get from a company paid for pension, there is $1 deducted from your potential workers' compensation rate. However, I may be able to help you. It's definitely worth talking to me about. I specialize in workers' compensation and am a former member of the Workers' Compenation Appeal Board.
