Legal Question in Workers Comp in Michigan

Injured and dropped

I work for a construction company in the administration sector. There was a pressing deadline to install 12 pieces of glass into hollow metal door frames. Each door frame required two pieces of glass and each piece of glass required 10 - 15 self tapping screws (metal screws)and caulk on both sides of each piece of glass. After installing the glass with a manual screw driver i noticed 1-2 days later a persistant pain in my right wrist and thumb area. My employer was informed of the injury but initially blew it off. There was never a report filed by my employer nor was there any information posted at the job site or office. When the wrist continued to hurt i felt it was time to see a doctor. The doctor indicated there was ligiment damage and will require surgery to fix. My employer was told this information and was informed of the surgery date. After my surgery i was told to recover for 1 week or until my post operation check up; which i did. When the first week after my surgery was up i was expecting to get paid because this was a work related injury i did not get paid and was told i wouldn't get paid.

Thanks for your attention in this matter.

Re: Injured and dropped

Go to the Bureau of Workers Comepnsation in the county where the injury occurred and fill out a petition explaining why it is work related. Make sure you ask for a mediation hearing. Get a statement from your doctor saying that the twisting motion described by you caused the ligament damage. Perhaps you will settle. However, the comp act has a provision that says they do not have to pay wage loss if you are only off one week. If you are off two weeks, then the employer has to pay for both weeks. therefore, it may be a waste of time. Bill Stern
