how long can workers comp make you participate in vocational rehab.

i had shoulder surgery in 1999,it was a work injury. after every think was over i was left on restrictions for the rest of my life. the company kept me there on a lite duty job till march 2001. they put me off on worker comp and are making go out and look for jobs. i have been do this job hunting for a 18 months now. my question is how long can they make me do this? i'm very stressed and i'm in alot of pain and really tard of doing this. thank you

Actually, they have the responsibility of finding you a job within your restrictions and qualifications. You don't have to 'pound the pavement'. However, if they are finding you the jobs and you show up and find that you cannot do it, as long as it was done in good faith, you have to do this a "reasonable number of times". Otherwise, they will cut off your comp and you will have to file a petition and have a hearing, all the while not getting paid. As you can see, it is hard to be an injured worker. You do have some other options, such as settling your case for a large, lump sum of money. Perhaps that is what the insurer is trying to get you to do. If you take that route, get an experienced workers compensation lawyer. You will not have to pay a fee out of your pocket and if you do settle, the attorney's fee would be only 10%, as you still are getting paid voluntarily. Therefore, the fees are extremely low and the benefit to you very high. If you wish to discuss this with me, give me a call.
