Legal Question in Workers Comp in Michigan
slip and fall
I work in Michigan-the other day I walked into the building went into the bathroom and fell on the fall. My feet were wet and I slipped on the tile. There was someone in the bathroom with me. I could not get up -I went to the hospital via ambulance. Results were nothing broken, muscle strain in my back and knee. Now my employer does not own the building -he is a renter. Is this workers comp or should I look to the landlord.

Re: slip and fall
it is both a claim against the landlord and workers comp. Comp pays for lost time (at the statutory rate) and medical bills. Comp gets reimbursed about 66% of what they pay from the case against the landlord. Now, the reality is you have a pretty poor case on liability against the landlord. Michigan law makes it virtually impossible to collect from landlords in these situations because the appellate courts have ruled that you should have seen the slick floor. Unless you are off for more than 7 days, you have no wage loss under comp. Therefore, forget about it and get back to work. William S. Stern
