As it stands now, it is not the end of the world and we can make it work for us. The test is whether the employee can return to work at maximum wages. If not, he gets comp. It does not mean that if the employee can do some other, lesser job, that his comp rate is reduced. That is probably where the insurance company controlled appellate courts will go in the future, but they are not there yet. However, we still stand the burden of showing the limitations of the employee and what jobs are out there so we are generally getting vocational assessments for our clients. Sometimes, we are sending interrogatories to the company. The general problem so far is that it has jacked out the cost of the plaintiff lawyers because of the need to send our clients for vocational assessments. That is generally the goal of the Supreme Court...to make our lives miserable. William S. Stern
