Need surgery for Herniated Discs but W/C wont let me
7/11/05 Date of work injury with witness. 2 days later went to shop clinic and was diagnosed with a shoulder strain. Over the course of a month and a half of repeat clinic visits and P.T. I was getting worse. My nurse case mngr. and I thought it time to see my own doc. So I went to my ortho doc. he took an x-ray of my shoulder along with an exam and said this had nothing to do with my shoulder and sent me back in for a neck x-ray that showed what he thought were 2 herniated discs. he ordered an M.R.I. an E.M.G. and P.T. and sent me to a neuro surgeon who said I had degenerative disc desease. cort. shots won'twork I need 2 fussions.The E.M.G. showed damage in the time frame of my injury. Ins. comp. sent me to an I.M.E. an ortho surgeon his bottom line was I may not require surgery and thought I could work at or below shoulder level and wear a speed shield. So Ins. comp. says no surgery and contacted my company to let them know my restrictions. I told her that no way could I work. I had to cancel my surgery and they had concerns about my going back to work. I am a heavy metal fabracator It's been 3 weeks now and I have not heard a thing from anyone. I tried to pick up my activities around the house and paid hell for it. I need help.

You need to file a petition for workers compensation. You should see an experienced workers compensation lawyer to do this as ultimately, the ability to prove your case will depend upon the skill of the lawyer in bringing out favorable medical evidence.
