Legal Question in Workers Comp in Michigan

Unauthorized payroll deduction

The company that I work for started a payroll deduction for health insurance, about a year ago. Before that time they paid 100% of the insurance. I was informed that the deduction was happening, and I had no choice in the matter. They did not have us sign a payroll deduction authorization. My first question is, Is this legal?

My second question is: The company is planning to increase the amount of this deduction. If I fight an increase and get terminated, will I be eligible for Worker's Comp?

The company can pay you whatever they want, as long as it does not violate any union contract (which I assume you do not have) or unless it is below minimum wage. So the deduction is allowed because they are not required to pay you any particular amount. If they fire you, workers comp is not a remedy as it only protects you for a wage loss that occurs due to a job related injury. Bill Stern
