Legal Question in Workers Comp in Michigan

WC claim after leaving employer

Worked at a retail store, hurt my arm at work lifting boxes in March 2005. Saw my doctor, sent for tests, off work for a week, was told I have Impingement syndrome in left shoulder. Doctor said there was no way to prove how much pain I was in so she had to send me back to work, gave me option of going to PT so I went a few times then quit because it made me hurt worse. Was demoted at work from a manager to a cashier so I quit and am currently collecting unemployment from this employer. Since I have left the company my arm has continually gotten worse. Can I return to the doctor and still have workmans comp pay?

Re: WC claim after leaving employer

The workers comp carrier will not pay this on evoluntarily because you have complicating factors, such as getting unemployment, returning to work for awhile, etc. You will need to file a petition, preferably through an experienced workers comp lawyer. Feel free to give me a call. I have 29 years experience and was a former adjunct member of the Workers Compensation Appeal Board. William S. Stern
