Legal Question in Workers Comp in Michigan

Worker's Comp Denied

I have been off work for the past month because of RSI from lifting. I was hurting all over with most pain in elbow(tendinitis). Went to Physiologist who diagnosed this and ordered EMG for suspicion of CTS. EMG test revealed moderate Carpal Tunnel in both hands(I had only recently had symptoms, but did not think it was anything to be concerned about). Also have degenerative disks in neck(not from working). Have been in therapy for strains to elbow, neck and shoulders. Have only worked for this company for about 6 weeks before injuries occurred. Insurance carrier has now denied my claim stating; I went to Dr. for my elbow, not my hands and therefore WC is denied.

What course of action can I take, if any?

My employer is self-insured.

See a workers compensation attorney and file a petition. Unfortunately, while the case is pending, you will have no income. You will be forced to take a job. This will diminish the value of your workers compensation claim but the insurers know this and count on it. If you give me a call tomorrow, we'll get you in. Ask for my assistant Phyllis.
