Legal Question in Workers Comp in Michigan

workerscomp

I injured my back at work I have a herniated disk. I was on workers comp for 4 months and then was released and was told that if i had any other problems to comeback then because they might have to do shots and maybe surgery. Two weeks after I was released I did some wok for 1 day and by the end of the day i was in so much pain that i had tears in my eyes. I called so that I could go back top the doctors and the insurrance company that handled the workers comp said my case was closed and that they would not handle it that they was not resonsible anymore. What are my rights and what should I do about this matter? Are they responsible still or not.

Re: workerscomp

The question is, are you still working? If so, it becomes difficult because to get your medical bills paid, treatment, etc., it takes medical testimony......not simply records, but actual testimony. The doctors don't do anything without substantial money. There is no way for a lawyer to get paid anything unless weekly benefits arean issue (meaning that you are sustainig a wage loss). There also is no way for you to win the case without a competent workers' compensation lawyer. Therefore, if you are still working, I do not believe that any lawyer will financially be able to do what it will take to win your case. However, perhaps something could be accomplished by mediation. A petition is filed filed requesting mediation and the mediator will try to urge the insurance company to pay the medical bills. The mediator has no actual power but he or she can urge the insurer to do the right thing. Feel free to give me a call if you are in the Wayne, Oakland or Macomb county area. William S. Stern
