what's my first step in filing a workmans comp claim?

The first step should be to see an experienced, well qualified lawyer who specializes in workers compensation claims. Workers compensation at first glance seems relatively straightforward but it is an area of law filled with pitfalls for the uninitiated. That lawyer will interview you and ask relevant questions. The lawyer will then file a petition with the Michigan Department of Labor in your behalf. that petition (that you will have signed) will be forwarded directly by the State of Michigan, to the proper workers' compensation insurer. That insurer will assigned it to an attorney. The state will then send the petition to the proper Bureau who will schedule a pre-trial at which time the magistrate on the case will post a first trial date on the door. That first date will be a time for the lawyers to meet with the magistrate. The case will wind its way through the system. Most of these cases take about 9 months to a year to resolve.
