Legal Question in Disability Law in Minnesota

Skills testing and the ADA

If the ability to differentiate colors is required for a position, is it legal to test applicants for color blindness and screen out those who indicate an inability to differentiate colors? Are there any restrictions to testing against a specific disability, such as color blindness?

Re: Skills testing and the ADA

If the ability to differentiate between colors

is (1) a legitimate requirement of the job and

(2) an "essential function" of the job and

you cannot perform that with a reasonable

accommodation, you have no case.
