Appeal of contractual binding arbitration

As a union leader can I appeal a decision of a arbitrator that was placed in a binding arbitration board award? Done under the Railway Labor Act.

Binding arbitration is usually, just that, binding. How appeals ofccur may depend on the arbitration statute that applies. In Minnesota it isSec. 572.19. In federal Code, it is 9 USC sec. 1

The statutes that apply to vacating an arbitration award include only very narrow exceptions where an appeal can occur. Generally, the basis would include:

(1) Arbitrator corruption;

(2) Fraud or other undo means;

(3) Evident partiality by the arbitrator;

(4) The arbitrator exceeded his/her powers provided by arbitration agreement;

(5) No arbitation agreement exist.
