Yes my question is my finacee was sentenced in 1999 and did 6 years in prison. And I havebeen goingool for my AS in Paralegal working towards my law degree. And i did research into his case because every since i have always felt somethings where wrong in his case. I found that they gave him a double upward departure with no warning and or written reason from the judge. Also they used his juvenile record to count his points and he was under the age of 25 at the time. His sentencing fell under 3 marks and he only had one. Is there a statute of limitations on appealing his case and or sentencing? And how would we go about it? Thank You

If he has been released from prison, there is really not much of a point in seeking post conviction relief now. Generally, post conviction release remedies are used to seek a new trial or a release from incarceration by argung an ineffective assistance of counsel and otehr remedies.
