Legal Question in Bankruptcy in Minnesota
Bank claim on Life Insurance after chapt 7?
A bank did not release a claim to a
life insurance policy on a person who
had completed Chapter 7 bankruptcy
in the summer of 2006. The bank
debts were discharged in bankruptcy.
6 months later the person died. The
bank demanded payment of the old
debt from the Life Insurance Co, who
had not received a release prior to
the death. The bank should not have
been paid? The bank should have
released all the money to the
beneficary of the policy?

I would start by talking to at least two people: a representative of the insurance company and the attorney who handled the bankruptcy. You are going to have to review the security documentation.
