Legal Question in Bankruptcy in Minnesota
Bankruptcy
My husband and I owe past federal and state income taxes and want to file bankruptcy to pay them back. Will this stop the penalties and interest from continuing to accrue? Will this stop them from garnishing our wages, etc.?

For your information, taxes, penalties and interest for returns actually filed more than three years ago are dischargeable in bankruptcy. Otherwise they are not dischargeable and, therefore, the tax authority may continue to enforce collection. However, it would certainly delay them. The best thing to do is to sit down with the tax authority and work out a payment program. Dennis
