Legal Question in Bankruptcy in Minnesota

Bankruptcy Trustee

Can a person file suit against a Bankruptcy Trustee who mishandled a Bankruptcy case. The Trustee took over a lawsuit I had going that damages were to be $300.000 to $1.000.000. But the trusty took it over to pay off creditors first yet she did not know there was a statue of limitations and she bragged in the newspaper how I should have known the law, but turns out she did not know the law after I repeatedly told her she needs to file so that the statue for filing does not run out. A District Judge turned over a lawsuit to the Bankruptcy Trustee and she was to file it in 30 days. She admitted she did not know there was a statue of limitations. The case got dismissed not on the merits of the case, but because she failed to file in time. Can I file a lawsuit against her and if so, what are the timelines to do so? I still have the entire file on the case and both newspaper stories that tell what happened

Re: Bankruptcy Trustee

You need to talk to an attorney experienced in handling malpractice cases. There are possibly two possibilities -- proceeding against the trustee's bond and proceeding aginst the trustee's attorney. However, it will not be easy.
