Legal Question in Bankruptcy in Minnesota
Please clarify my bankruptcy question!
Do I as a lender have any rescourse on a mortgage that was not discharged in a chapter 7 bankruptcy filed less than 30 days after our mortgage. The borrower closed on 4/12 and filed bankruptcy on 5/5. We foreclosed on the property but I was curious if there are guidelines pertaining to new debt acquired within so many days of filing bankruptcy. Any help you can provide would be appreciated.
Thanks

Re: Please clarify my bankruptcy question!
I'm not sure I understand the problem. If it was "not discharged", then the bankruptcy essentially doesn't count. If you completed your foreclosure, you're all set anyway.
If you are thinking about objecting to the bankruptcy, usually you have to do that within 90 days of filing.
This question needs clarification.
