Legal Question in Bankruptcy in Minnesota

Co-signer on a vehicle

My bankruptcy dishcharged last year, and I have a vehicle with an outstanding lien. I decided not to sign a reaffermation agreement, but have not been paying the loan, becuase they have not called, sent a statment or attempted to contact me in any way. My question is: I originally had a cosigner on the car, but the only document they signed was the title. Does that legally bind her to the contract of the vehicle? She never signed the contract at the dealership or through the finance company. Can I get her taken off? This is ruining her credit and I need to get it taken care of!! Please help!

Re: Co-signer on a vehicle

It would be very unusual to be just signing the title. The operative document that creates the loan is the promissory note. The question is who signed that.

I would be glad to consult with you about this. 952-544-6356.
