Legal Question in Bankruptcy in Minnesota

Deposit Accounts in bankruptcy

If a I have a deposit account at a credit union with a balance that has been there more than a year and have just filed bankruptcy, does the credit union have to send the money to me or can they keep it to offset debt?

Re: Deposit Accounts in bankruptcy

In most of my cases they keep the money. I don't know if that's legal, but no client of mine has had the resources to challenge it if it's not.

The trick is to withdraw the money before filing - and give it to your lawyer of course to pay his or her fee.
