Legal Question in Bankruptcy in Minnesota
I am going to file bankruptcy I want to include a personal loan my ex took out in his name for me. I can not afford to pay it any more. Im worried something would happen since we have a child together and I wanna stay on good terms. Can he file something against me to get it included?? How do I do it??

You are required to list all debts in any bankruptcy. You don't get to pick and choose. So you have to list the debt in question if your name is on it or if there is any reason to believe that you owe it. Since you have been paying on it, that's reason to believe you owe it. So you better list the debt.
In addtion you need to list your ex, since once you stop paying the loan they will likely come after him. That would create a claim against you that he would have. Therefore he must be listed. Again you have no choice. All debts or all possible debts must be listed.
This is for general informtion purposes only, is not legal advice, and does not create an attorney-client relationship.
