can you file bankruptcy on your mortgage and does it matter that im behind on payments?

You must list all assets and all creditors in a bankruptcy case. There are no exceptions to this. If you wish to keep the house and have sufficient resources to continue making payments over time and can pay the arrearages over 5 years, you may wish to consider a chapter 13 payment plan. If these house is upside down and you cannot afford it, you may wish to consider a Chapter 7.
