Legal Question in Bankruptcy in Minnesota

High unsecured debt

Can just my spouse file Chapter 7 bankruptcy even though I make over $125k per year and am unable to due to high monthly expenses?

She works part-time, has a small income but owes over $25k to credit card companies.

You might run into issues with the means test. Under the circumstances you set forth, you might be better off negotiating off her debts.
