Legal Question in Bankruptcy in Minnesota

Renting after Bankruptcy

I filed for bankruptcy in Dec. 2004 and it was discharged in March. Right now we are renting and looking to move elsewhere. Before I start filling out applications and paying tons of fees, I would kind of like to know if I will be denied because of my bankruptcy. In Minnesota what exactly is the guidlines for that, can I be denied because of it, or just have to pay extra deposits? Any help would be great.

Re: Renting after Bankruptcy

There are anti-discrimination provisions in the bankruptcy code concerning landlords, but it appears they only apply if the landlord is getting government money such as Sectin 8 money. It looks as if everyone else may consider the bankruptcy as part of your credit history.

How much trouble you will have could depend on what else is in your history in addition to the bankruptcy. In many cases a bankruptcy could make your credit look better not worse, since it lightens the debt load.

If I were the landlord I would be most interested in what other landlords thought of you. If you have a good recommendation from a previous landlord, that would carry a lot of weight.

Good luck
